1. Introduction
These Terms of Use (“Terms”) govern the membership and participation of any player (“the Player”) in the programmes, activities, and services provided by Silver Studs Football Club (“the Club,” “we,” “our,” or “us”). By completing the registration process and paying the applicable fees, the parent(s) or legal guardian(s) (“the Parent/Guardian”) agrees to be bound by these Terms on their own behalf and on behalf of the Player.
2. Membership and Registration
2.1. Membership is for one playing season (as defined by the Club) and is subject to annual renewal.
2.2. Registration is only complete upon the Club’s receipt of a fully completed registration form, acceptance of these Terms, and payment of the required fees.
2.3. The Parent/Guardian warrants that all information provided during registration is accurate and complete, particularly regarding the Player’s health, medical conditions, and emergency contact details.
3. Fees and Payment
3.1. All fees (including membership, training, and match fees) are as published by the Club and are due in advance, unless otherwise agreed in writing.
3.2. Payment must be made via the methods specified by the Club and by the due date. Late payments may result in the Player’s suspension from training and matches.
3.3. Fees are non-refundable except at the absolute discretion of the Club management in exceptional circumstances (e.g., long-term injury verified by a doctor’s note, or permanent relocation). No refunds will be given for missed sessions due to illness, holidays, or other personal commitments.
4. Commitments and Expectations
4.1. Club Commitment: The Club is committed to providing qualified coaching, a safe environment, and a positive, developmental football experience in line with its stated philosophy.
4.2. Player Commitment: The Player is expected to:
* Attend sessions punctually and regularly.
* Display respect towards coaches, teammates, opponents, and officials.
* Adhere to the Club’s Code of Conduct.
* Wear the designated training kit and bring necessary equipment (e.g., water, shin pads, football boots).
4.3. Parent/Guardian Commitment: The Parent/Guardian is expected to:
* Ensure the Player’s punctual collection and delivery.
* Support the Player and the Club’s ethos positively from the sidelines.
* Inform the Club of any absences, injuries, or relevant changes in circumstances in a timely manner.
* Adhere to the Club’s Parent/Guardian Code of Conduct.
5. Health, Safety, and Welfare
5.1. The welfare of our players is paramount. The Club adheres to a strict Safeguarding and Child Protection Policy.
5.2. The Parent/Guardian must inform the Club in writing of any medical condition, allergy, disability, or special educational need that may affect the Player’s participation.
5.3. In case of a medical emergency, the Club reserves the right to administer first aid and seek professional medical assistance immediately. The Parent/Guardian agrees to bear the cost of any such medical treatment.
5.4. The Parent/Guardian is responsible for ensuring the Player is in a fit physical condition to participate in football activities.
6. Liability
6.1. The Club will not be liable for any loss, damage, or injury to any person or property, howsoever caused, except where such liability cannot be excluded by law.
6.2. Participation in football carries a inherent risk of injury. The Parent/Guardian acknowledges this risk and accepts it on behalf of the Player.
7. Use of Image
7.1. The Club may take photographs and video footage of players for coaching purposes, internal use, and promotional materials (including the website and social media).
7.2. Upon registration, the Parent/Guardian grants the Club a perpetual, royalty-free licence to use such images and footage for these purposes.
7.3. If the Parent/Guardian does not grant this consent, they must inform the Club in writing at the point of registration.
8. Player Pathway and Transfers
8.1. The Club’s Player Pathway is designed to support talented and dedicated players seeking opportunities at higher levels.
8.2. The Club may, at its discretion, facilitate trials or recommend players to partner clubs, college programmes, or international academies.
8.3. The Parent/Guardian agrees that any approach from another club regarding the Player’s transfer must be conducted through the Club’s management, in accordance with the rules of the relevant football association.
9. Data Protection
The Club will collect and process personal data in accordance with its Privacy Policy, which is incorporated into these Terms by reference.
10. Discipline and Termination of Membership
10.1. The Club reserves the right to suspend or terminate the membership of any Player or Parent/Guardian for conduct deemed to be in breach of these Terms or the Club’s Code of Conduct, or which brings the Club into disrepute.
10.2. In the event of termination, no refund of fees will be given.
11. Variations
The Club reserves the right to amend these Terms of Use at any time. Notice of any changes will be provided via email or displayed on the Club’s website. Continued use of the Club’s services after such notice constitutes acceptance of the revised Terms.
12. Governing Law and Jurisdiction
These Terms and any dispute or claim arising out of them shall be governed by and construed in accordance with the laws of Zimbabwe and submitted to the exclusive jurisdiction of the courts of Zimbabwe.
